Terms and Conditions for Using the MIA Instant Payments Service from Victoriabank

The terms and conditions for using the MIA Instant Payments service activated through Victoriabank (hereinafter referred to as the “Victoriabank MIA Instant Payments Terms”) constitute a legally binding contract between B.C. Victoriabank S.A., with its registered office in the Republic of Moldova, Chișinău, 141 31 August 1989 Street, tax ID 1002600001338 (hereinafter referred to as “Victoriabank” or “the Bank”) and you (“the user”).

We recommend that you read these Victoriabank MIA Instant Payments Terms in their entirety before deciding whether to accept them and proceed with activating this payment service. If you do not agree with any of the provisions of these terms or if you do not wish to give your consent to the processing of your data, in accordance with the provisions of the Privacy Notice regarding the processing of personal data within the Victoriabank MIA Instant Payments service, please do not activate or use this service. If, at any time after activating the MIA Instant Payments service, you decide that you no longer agree to these Terms or wish to withdraw your consent to use the MIA Instant Payments service, please deactivate the service.

The MIA Instant Payments service is offered to you independently of any other Victoriabank service. You may use other Victoriabank services without being required to activate and/or use the MIA Instant Payments service.

MIA Instant Payments is a payment service offered by Victoriabank in collaboration with the National Bank of Moldova (hereinafter “BNM”), as well as other financial institutions in the Republic of Moldova. This service allows individual users to receive amounts in lei (MDL) based on their phone number into their personal account opened at Victoriabank—for which they have activated this service—from any customer of a participating financial institution.

The NBM is the institution that maintains, in a centralized database (CAS – Central Addressing Scheme), the data of customers of participating financial institutions who have activated the service; this database is necessary for the payment service to function.

Activating MIA Instant Payments does not guarantee that you will receive funds through this service, but only that you have the ability to receive them. Even if you have activated the MIA Instant Payments service, the payer—a customer of a participating financial institution—may decide to transfer funds to your accounts at Victoriabank using other methods, such as a direct transfer to the IBAN of the account where you wish to receive the funds, P2P (directly to a card), or Send to Friend.

Within the Victoriabank MIA Instant Payments service, a user’s phone number is used as a proxy/alias (intermediary interface) for a checking account or card number (IBAN). A phone number can be associated with only one account in the NBM database for the MIA Instant Payments service.

To activate Victoriabank’s MIA Instant Payments service, you must be a resident individual account holder. You can activate this service through the Victoriabank internet banking app, where your identity will be verified in advance using the authentication methods available in that app.

To use the MIA Instant Payments service, the phone number provided in the customer questionnaire—which you completed and signed when you opened your account and/or when updating your information regarding your relationship with Victoriabank—will be used.

Immediately after activating the MIA Instant Payments service, we will submit to the National Bank of Moldova the information necessary to provide this service, namely: the phone number, the IBAN of the account opened at Victoriabank associated with the phone number, the IDNP, as well as the first and last name you provided in the customer questionnaire, which you completed and signed at the start of your relationship with Victoriabank and/or when updating your account information.

At any time after activation, if a customer of a financial institution initiates a payment via MIA Instant Payments to your phone number, the financial institution of the payment initiator will query the NBM database for your phone number, as well as your other information associated with it (the IBAN of the account opened at Victoriabank, first and last name, IDNP), and the NBM will provide this information, regardless of whether the initiated transaction is successfully completed or not. If you do not wish to consent to such processing of your data subject to banking secrecy—which may, as applicable, also constitute personal data—please do not activate MIA Instant Payments.

If you have the MIA Instant Payments service activated, any customer of another participating financial institution—as well as of Victoriabank—can transfer amounts in MDL to the Victoriabank account you have linked to this service, by entering the phone number you used to activate the service into the payment app of that participating financial institution.

The amount entered by the payer will be credited to your Victoriabank account linked to the MIA Instant Payments service. You will receive the amount in your account instantly.

You will not be able to receive the amount in any Victoriabank account other than the one set up for MIA Instant Payments, nor will you receive the amount in your account if the Payer initiates a payment to a different phone number of yours, other than the one for which you have activated MIA Instant Payments.

a. Modifying the MIA Instant Payments service at your request

If, at any time while you are using the MIA Instant Payments service:

  • you wish to use a different phone number or a different account opened with Victoriabank to receive funds via MIA Instant Payments;

  • you no longer use the phone number with which you activated this service;

  • you have changed the first and/or last name associated with your account and phone number in MIA Instant Payments

You will need to update your information in the customer questionnaire (KYC). Therefore, once your information is updated:

  • If you have changed the first and/or last name associated with your account and phone number in MIA Instant Payments, this information will be submitted to CAS BNM for updating;

  • If you have updated your phone number, you will be automatically unsubscribed from the MIA Instant Payments service.

If you wish to continue using this service, you will need to reactivate it from the internet banking app menu.

b. Termination of the MIA Instant Payments service at your request

If you no longer wish to have the MIA Instant Payments service active, but the linked Victoriabank account remains open, you must deactivate the service directly from the internet banking app.

If your business relationship with Victoriabank ends at your request, or if you simply ask the bank to close the account linked to the MIA Instant Payments service, the provision of this service will automatically cease.

c. Termination of the MIA Instant Payments service at Victoriabank’s initiative

If, while the MIA Instant Payments service is active, the Bank decides to close your Victoriabank account linked to MIA Instant Payments on its own initiative, the collection service will no longer be available; however, you will be able to continue initiating transactions from a valid account. If the Bank initiates the termination of the business relationship, the provision of this service will automatically cease.

The grounds that may lead to the termination of the business relationship at the bank’s initiative are those set forth in the General Terms and Conditions applicable to individuals at Victoriabank.

Any payments initiated to you via MIA Instant Payments after the alias has been deactivated will no longer be credited to the account linked to that alias.

At the time of activation and throughout your use of the MIA Instant Payments service contracted through Victoriabank, you represent and warrant the following:

  • that you have the right and full legal capacity to activate and use MIA Instant Payments on the account you have linked to it;

  • that you are the user of the phone number on which you are activating this service;

  • you agree to update your information with the Bank as soon as you no longer use the phone number on which you set up MIA Instant Payments;

  • you assume full responsibility in the event that the phone number on which you activated MIA Instant Payments actually belongs to another person who has set up this service, so that amounts transferred using that number end up being credited to that person’s account linked to the phone number;

  • you assume full responsibility in the event that you provide individuals who wish to transfer funds to you via MIA Instant Payments with a phone number other than the one you used to activate this service with Victoriabank;

  • You confirm that you have read these MIA Instant Payments Terms, which are necessary for you to give your free and informed consent for subscribing to this service and, respectively, for the processing of your personal data by participating financial institutions and by the NBM for the purpose of providing the MIA Instant Payments service;

  • By using the app, you will not violate any laws or regulations of the country in which you reside, and you are solely responsible for complying with all applicable local laws and regulations.

We may amend the Victoriabank Instant Payments Terms at any time by publishing an updated version in the Victoriabank apps where you can activate this service and on the bank’s website. If you do not agree with the updated Terms, you can deactivate your alias.

The terms and conditions for using the MIA Instant Payments service, as set forth in this document, are and will be governed by and interpreted in accordance with the laws of the Republic of Moldova.

In the event of any conflicts or disputes arising from the use of the service, we will seek to resolve them amicably, as necessary in conjunction with other participating financial institutions and/or the National Bank of Moldova (BNM), with such negotiations conducted in good faith.

All disputes will be resolved in the competent courts of the Republic of Moldova.

Victoriabank is not liable to the user for failure to fulfill any obligation in the event of a justifiable impediment, nor for the operation and connection of other domestic or foreign networks, nor for their activities and actions in general.

Force majeure may include, but is not limited to: a state of war (whether declared or not), armed conflict, revolution, insurrection, military or terrorist actions or threats, sabotage, civil unrest, strikes or other labor actions, laws, regulations, decisions, or directives, natural disasters, earthquakes, fires, explosions, solar or meteorological disturbances, public emergencies, or any other event beyond the bank’s control.

Before you decide whether you want to become a user of the MIA Instant Payments service, it is important to understand how your personal data would be processed in connection with your use of this service, as you would be the data subject of such processing.

The payment system operates by exchanging the information necessary to initiate or receive payments based on an alias. The exchange of information will take place through a shared database, which will be managed by the National Bank of Moldova.

Personal data is processed for the purpose of providing a service to facilitate the initiation/receipt of payments based on a phone number (alias/proxy), solely within the territory of the Republic of Moldova. The categories of data processed are first and last name, phone number (alias/proxy), IDNP, and bank account IBAN.

If you activate the MIA Instant Payments service through Victoriabank, we are the controller that will collect this data and transmit it to the National Bank of Moldova, where your data will be stored.

Whenever a customer of a participating financial institution initiates a payment to you by entering the phone number with which you activated the MIA Instant Payments service, that participating financial institution will retrieve this data from the database managed by the National Bank of Moldova and will provide its customer initiating the payment with your first and last name (in the format: Ion P.) for inclusion in the payment order. That bank/participant in the payment system and its customer who initiated the payment based on your phone number will have access to your data, regardless of whether that payment is completed or not.

The processing operations described above are necessary for Victoriabank to provide you with the MIA Instant Payments service, but they can only be carried out with your consent to the processing of this data.

You are not required to give this consent in order to receive funds from customers of other financial institutions into your accounts held with Victoriabank. However, if you wish to initiate such a transfer by entering your phone number instead of your IBAN, or if you wish to use the MIA Instant Payments service, you must provide this consent. You have the right to withdraw your consent to the processing of your personal data within the MIA Instant Payments service at any time by deleting the alias from the Victoriabank app where you created it.

Your personal data related to the MIA Instant Payments service contracted through Victoriabank will be stored in the database of the National Bank of Moldova, and will thus be available to other participating financial institutions and their customers who initiate payments, for as long as you use the MIA Instant Payments service.

With regard to the processing of your personal data within the MIA Instant Payments service, you are guaranteed the exercise of the rights provided for by Law No. 133 of July 8, 2011, on the protection of personal data.
